When Section 13 applies
If you want to increase rent on a periodic tenancy, you must serve a Section 13 notice using the prescribed Form 4A. You cannot simply write to the tenant — it must be the correct form.
Key requirements
- Minimum 2 months' notice before the increase takes effect.
- The new rent must take effect on the first day of a new period of the tenancy.
- You can only serve one Section 13 notice per 12-month period.
Tenant rights under RRA 2025
Under the Renters' Rights Act 2025, tenants have stronger protections against rent increases:
- A tribunal cannot set the new rent higher than the landlord proposed.
- A tribunal award cannot be backdated.
- A landlord cannot evict a tenant for challenging a rent increase at tribunal.
